In fact, the fee that their own solicitors may charge them just for crossing the doormat is of serious concern. Nobody likes to be in a position of not knowing what it is going to cost them. Conditional Fee Agreements (or no win no fee arrangements) mean that the Claimant is not paying for the solicitor's time as the case progresses although there may be some costs. We all love to win a case. When solicitors take your case on a conditional fee basis, they are investing their own time and money into the claim as they do not receive their fee until the end of the matter and only then if you win. So they take the case very seriously indeed. They want to win as much as you do because without that win, there is no fee income for them. On the other hand, litigation is never a guaranteed win and in normal cases, if you lose, you are liable to pay the other side's costs (including their solicitor's fee) but there is protection for you in this scenario as you will be able to take out insurance. Then if your opponent gets a win you do not pay their solicitor's fee or your own solicitor's fee. It's a win/win situation!

Changes in the rules about no win no fee

In early 2010 The Jackson Report suggested various changes to the way no win, no fee cases are managed. After a consultation period, these changes have now been included in a Parliamentary Bill awaiting ratification. If you have a claim, then now is the time to take action as it may be difficult to get a no win no fee arrangement when this bill is passed and the new rules come in. These have now been delayed until April 2013.
